• No purchase necessary to enter or win.

• Maximum number of entries – You may only enter 1 time every 12 months – Duplicate entries may disqualify all entries.

• Home of service must be in our service area. 

• Contestants must own the home at the time of drawing AND at time of installation to qualify.

• Contestants are responsible for costs over $10,000.

• Permits, permit fees, taxes and code upgrades are not included.

• Must prove homeowners’ insurance for at least 1 year prior to installation.

• Value is UP TO $10,000 for a bath, shower or walk-in tub. (Moving of walls, and other bathroom remodeling and fixtures is not included.)

• Giveaway is for 1 bath or shower and remaining budget may not be used for other work, services or other rooms.  

• Not transferrable to other persons.

• No cash value.

• Prize does not include glass doors or barriers.

• Contract must be signed authorizing work on home, scope of services and any out of pocket expenses there may be.

• Sub-contractors used for Electrical or other services, not provided by Innovative Baths, are NOT included in the giveaway and will be an additional cost.

• Warranty terms and conditions will follow our standard contract terms, where all product warranty will prevail.  Workmanship will only be guaranteed for 1 year and not transferrable to new buyers of home. 

• Contestants must be 18 years of age or older.

• Contestants agree to their name and photo to be used for marketing purposes for Innovative Baths and family of brands.

• Winners agree to leave a 5-star review in at least 3 locations on social media such as, Google, Facebook, BBB, etc. Failure to do so within 10 business days of the completion will result in an invoice for full market value of the services provided that will be due upon invoice. 

• Contestants agree to be contacted by Innovative Baths and family of brands for marketing purposes via, phone, email, text or US Postal service.

• We will not sell your information to others for marketing purposes or any other reasons.

• We will only draw a winner 1 time per calendar year.

• Methods to enter – Home Shows and events we have set up, Facebook, Google, Website, texting 931.228.0850.

• Winner must be available for inspection within normal business hours to inspect for viability of winning.  Documentation of insurance and proof of home ownership must be provided within 10 business days of winning.

• Winner must have owned the home for a minimum of 1 year before winning.

• We reserve the right to select another winner based on any of the following: a) not meeting the terms of winning; or b) the winner being difficult and not agreeing to the terms.

• Winning is void if we cannot contact you with the information you provided on your entry form within 48 hours.

• Employees, employee family members and extended family are not permitted to win.  If it is discovered after the announcement, but before the service is performed, then the project will be cancelled, and a new winner will be selected.  If services have already been performed, then the non-eligible winner agrees to pay market value for services provided.

• Innovative Restorations LLC and its affiliates or subsidiaries are not responsible for property value increases based on winning this contest or the services that may be performed.

• Winners and contestants agree not to disparage, defame or devalue the company or its persons and representatives in any way on social media, online publications or by word or deed.

• Defamation and Disparagement. Contestants and winners agree that neither party will disparage or defame the other or take any action, directly or indirectly, to disparage or defame the other. For the purposes of this Section, “disparage” shall mean any negative statements, reviews, comments, or feedback, whether written or oral, that would cause the other party embarrassment or humiliation or otherwise cause or contribute to the party being held in disrepute, including but not limited to, any negative Internet postings concerning the other party or any of its employees, representatives, or subcontractors (collectively “Disparaging Publications”). This will include all written or electronic communication, whether email, text message, use of Yelp, LinkedIn, other social media and Internet sites, etc.

The parties further agree to immediately correct, redact, remove, or edit any publication that the other party deems a Disparaging Publication upon receiving written notice from the other party demanding the same, regardless of whether the other party disputes that the publication in question is a Disparaging Publication. 

All parties agree that if a breach of this Section were to occur, it would be difficult to determine actual damages. Based on what the parties presently know, they agree that $25,000 is a reasonable estimate of the damages that would accrue if a breach occurred in the future; and all parties agree that the amount of liquidated damages is fair and reasonable and would not act as a penalty to the breaching party. Therefore, if either party does not immediately correct, redact, remove, or edit any publication that the other party deems a Disparaging Publication the party in breach will pay to the other the amount of $25,000 as liquidated damages. 

The parties agree and acknowledge that this non-disparagement provision is a material term of this Agreement, the absence of which would have resulted in the Company refusing to enter into this Agreement. 

• Choice of law & fees, any disagreement of this contract will be handled in the Tennessee courts of Cumberland County, and the prevailing party is entitled to any and all court fees, attorneys’ fees and other collection fees incurred to enforce this agreement. 

• Arbitration of Disputes. Omitted intentionally.
